What is the debt recovery process?
Letter of Demand
- As soon as your invoice or debt remains unpaid as it falls due, you should send a Letter of Demand to your debtor, demanding full payment of debt with a given time (say, 7 days) and threatening a legal action if the debt remain unsettled by the extended due date
- A formal Letter of Demand under a law firm’s letter head delivers a strong message to your debtor that you are serious in recovering your money and is a cost effective way to start your debt recovery process as often your debt may be able to settle at this stage without the need of commencing litigation.
What if the Letter of Demand is ignored by the debtor?
- If the Letter of Demand is ignored or fully payment has not been received by the extended due date, subject to your instructions, we will file and serve Statement of Claim on your behalf and commence legal proceedings against your debtor.
Depending on the nature of dispute and amount of debt, the legal proceedings will commence in the one of the following Courts:
- Local Court Small Claims Division – For claims up to $10,000;
- Local Court General Division – For claims over $10,000 and up to $100,00;
- District Court – For claims over $100,000 and up to $750,000;
- Supreme Court – For claims over $750,000.
After filing your Statement of Claim at the Court, it is then up to your debtor to file his or her defence. If no defence has been filed within 28 days after the service of the originating process (that is, your Statement of Claim), you will be entitled to seek a default judgment against your debtor to recover your amount of claim, interest up to the date of judgment and costs.
Once the Court has entered a judgment in your favour, we will then be able to enforce the judgment against the debtor for you.
